SPONSORS. The Ultimate Functional Wellness Giveaway ("Giveaway") is sponsored by: (a) Moksha Chocolate, 2746 47th Street, Boulder, CO 80301, United States of America; (b) Peak State Coffee; and (c) MycoLove, (collectively, the "Sponsors").

ELIGIBILITY. The Giveaway is open only to legal residents of the United States who are at least eighteen (18) years of age at the time of entry. Void where prohibited or restricted by law. Employees, officers, directors, contractors, and immediate family members (spouse, parent, sibling, child, and their respective spouses) and members of the same household of each Sponsor are not eligible to enter. Sponsors reserve the right to verify eligibility and to disqualify any entrant who does not meet the eligibility requirements.

ENTRY PERIOD. The Giveaway begins on Monday, February 23, 2025 at 12:00 AM Mountain Standard Time ("MST") and ends on March 4, 2025 at 11:59 PM MST (the "Entry Period"). Entries submitted before or after the Entry Period will not be eligible. Sponsors’ computer systems and timekeeping devices are the official timekeeping devices for the Giveaway.

HOW TO ENTER. During the Entry Period, eligible participants must complete all of the following steps: (a) follow @mokshachocolate, @peakstatecoffee, and @mycolovefarm on Instagram; (b) like the official Giveaway post; (c) tag two (2) friends in the comments of the official Giveaway post; and (d) complete and submit the official entry form provided by the Sponsors. Limit one (1) entry per person. Multiple entries, entries generated by script, macro, bot, or other automated means, or entries that are incomplete, fraudulent, or otherwise in violation of these Official Rules may be disqualified at Sponsors’ sole discretion.

PRIZE. One (1) winner will receive the following: (a) Peak State 4-pack coffee bundle (Approximate Retail Value ("ARV") $100); (b) Moksha Chocolate mushroom wellness sampler plus functional cacao (ARV $90); and (c) MycoLove Core 4-bottle set plus Lion’s Mane GT Series (ARV $195). Total ARV of all prizes is $385+. Prize is non-transferable and no substitution or cash equivalent will be provided except at Sponsors’ sole discretion. Sponsors reserve the right to substitute a prize of equal or greater value if necessary. Winner is solely responsible for any federal, state, or local taxes and any other costs associated with acceptance or use of the prize.

WINNER SELECTION AND ODDS. One (1) winner will be selected in a random drawing from among all eligible entries received during the Entry Period. The drawing will occur on or about March 5, 2025. Odds of winning depend on the total number of eligible entries received.

WINNER NOTIFICATION. The selected winner will be notified via email using the email address provided at entry. The winner must respond within forty-eight (48) hours of notification to claim the prize. If the selected winner does not respond within the required timeframe, is found to be ineligible, or fails to comply with these Official Rules, an alternate winner may be selected. Sponsors are not responsible for failed delivery of email notifications due to spam filters, incorrect email addresses, or technical issues.

EMAIL AND MARKETING CONSENT. By entering the Giveaway, participants expressly consent to receive marketing communications from Moksha Chocolate, Peak State Coffee, and MycoLove. Participants may unsubscribe from marketing communications at any time by following the unsubscribe instructions included in such communications. Information collected will be used in accordance with each Sponsor’s applicable privacy policy.

PRIVACY. All information submitted in connection with the Giveaway will be treated in accordance with the Sponsors’ respective privacy policies. By participating, entrants agree to the collection and use of their information for the administration of the Giveaway and for marketing communications as described herein.

PUBLICITY RELEASE. Except where prohibited by law, acceptance of a prize constitutes the winner’s consent to Sponsors’ use of winner’s name, likeness, city, and state of residence for promotional purposes in any media without further payment or consideration.

RELEASE AND LIMITATION OF LIABILITY. By participating in the Giveaway, entrants agree to release and hold harmless Sponsors, Instagram, and their respective affiliates, subsidiaries, advertising and promotion agencies, and each of their respective officers, directors, employees, and agents from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of any prize. Sponsors are not responsible for: (a) technical failures of any kind; (b) lost, late, misdirected, or incomplete entries; (c) unauthorized human intervention; or (d) any injury or damage to persons or property related to participation in the Giveaway.

INSTAGRAM DISCLAIMER. This Giveaway is in no way sponsored, endorsed, administered by, or associated with Instagram. Participants release Instagram from any responsibility related to this Giveaway.

GENERAL CONDITIONS. Sponsors reserve the right, in their sole discretion, to cancel, suspend, or modify the Giveaway if fraud, technical failures, or any other factor impairs the integrity or proper functioning of the Giveaway. Sponsors’ decisions regarding all matters related to the Giveaway are final and binding.
